CRIMINAL POLICY FOR CHILDREN WHO COMMIT CRIMES FREQUENTLY FROM THE VIEWPOINT OF LEGAL GOALS

Criminal policy towards children who repeatedly commit criminal acts from the perspective of legal objectives, particularly within the Indonesian juvenile justice system. Practice of applying diversion to children who repeat offences still faces various substantial challenges, due to legal provisions that tend to limit the application of diversion for repeat cases, as well as less-than-optimal law enforcement effectiveness in promoting the social reintegration of children who are repeat offenders. This study emphasises the need for repeated reformulations of child criminal policy, which not only considers the repressive aspects but also prioritises the legal objectives of protection, rehabilitation, and preventing recidivism through a legal approach that is orientated towards the best interests of the child.
