Abstract

The present research is based on the premise that interconnection is one of the landmarks of the XXI century. No subject, discipline, right, social group remains in airtight compartments, oblivious to developments of other elements; on the contrary, more and more issues and paradigms are being confused, intertwined and complemented by other factors. In this sense, this article aims to discuss and analyze, through bibliographical and documentary research, the relationship between Law and Development, specifically the new vision of development and the constitutional framework of today’s Constitutions, influenced by the post-positivist paradigm. Furthermore, it investigates the influence, external and internal, direct and indirect, between the realization of the right to education in the constitutional frameworks and the context of developing nations.
