Abstract

A autora analisa a ampliação do poder punitivo do Estado, e isto em uma sociedade capitalista pós-industrial e globalizada marcada pela desigualdade e exclusão. Apresenta características e elementos de legislações de cunho autoritário para, em seguida, trabalhar esses elementos na legislação brasileira, que leva à expansão da pena privativa de liberdade, mas também à ampliação do espaço e das estratégias de punição do Estado. Enfim, a autora defende a prevalência dos princípios garantidores contra essa ampliação do poder do Estado de punir, propondo uma inversão das tendências criminalizadoras e a construção de outras bases para a sociedade contemporânea.
