A CASE STUDY OF CRIMINAL AND CIVIL LEGAL ACTION FACING ILLEGAL GOLD MINING VIOLATIONS IN MANDAILING NATAL, INDONESIA

Os abundantes recursos naturais na Indonésia, tanto renováveis quanto não renováveis, precisam ser geridos de forma otimizada para produzir mais para o bem-estar do povo. Um deles é a mina de ouro em Mandailing Natal, Indonésia, que tem grande potencial para a prosperidade da comunidade, especialmente da comunidade circundante, e fornece renda ao estado. Por esta razão, é necessária uma entidade legal para a mineração de ouro na área de Mandailing, para que os mineradores possam operar legalmente em seus negócios. Este é um problema legal que atingiu a mineração de ouro, de modo que a mineração ainda é categorizada como ilegal. A mina de ouro da área de Mandailing pode ser categorizada como um micro negócio realizado por pequenas comunidades na forma de mineração comunitária. Esta pesquisa foi realizada rastreando e analisando casos de mineração ilegal de ouro na comunidade Mandailing em termos das regulamentações legais que regem os atos criminosos de mineração ilegal de ouro no município de Mandailing Natal. Após as regulamentações legais, é claro que as causas dos crimes de mineração ilegal de ouro no município de Mandailing Natal são analisadas. A etapa final é analisar as políticas de direito penal contra os garimpeiros ilegais que ocorrem no município de Mandailing Natal. A análise de conteúdo é utilizada para obter dados através da consulta a registros judiciais, convenções sociais e regulamentos. De acordo com este estudo, o direito penal consuetudinário já havia sido implementado e seus princípios eram ainda mais reconhecidos pela comunidade do que as regras penais e civis que foram adotadas diretamente do livro de leis
