ENHANCING PERSONAL DATA PROTECTION ON E-COMMERCE PLATFORMS: A CASE STUDY IN VIETNAM

Resumo

No contexto do mercado de comércio eletrônico em rápida expansão do Vietnã, os dados pessoais tornaram-se um ativo crítico, impulsionando a personalização, a otimização de marketing e a tomada de decisões estratégicas. No entanto, seu uso levanta preocupações significativas sobre a privacidade do consumidor. Este artigo examina os métodos de coleta e utilização de dados pessoais em atividades de comércio eletrônico, categorizando-os em dados fornecidos pelo usuário (formulários de inscrição, pesquisas, avaliações) e dados coletados automaticamente (cookies, PNL, web scraping). O estudo analisa o papel multifacetado dos dados no aprimoramento da experiência do cliente, suporte à logística, atendimento ao cliente e prevenção de fraudes. Um foco central é a análise da estrutura legal do Vietnã para a proteção de dados pessoais, particularmente a introdução marcante do Decreto nº 13/2023/NĐ-CP. Embora o Decreto 13 represente um grande passo em direção à harmonização com os padrões internacionais, a pesquisa identifica desafios significativos de fiscalização, incluindo baixa conscientização pública, ausência de uma Autoridade de Proteção de Dados (APD) independente, ambiguidade na terminologia legal e dificuldades de conformidade para pequenas e médias empresas (PMEs). Com base nesta análise, o artigo propõe recomendações de políticas específicas para preencher a lacuna entre a legislação e a prática, incluindo o estabelecimento de uma APD independente, a emissão de diretrizes detalhadas, o apoio aprimorado às PMEs e a promoção de programas de educação pública para aumentar a conscientização da comunidade.
