JUSTIFICATIONS FOR CONSTITUTIONAL TEXT AMENDMENT RELATED TO PROCEDURAL CRIMINAL PROVISIONS

Formal grounds for constitutional change refer to the reasons or justifications that support undertaking an amendment or alteration to the constitution, focusing on procedural and structural aspects. Insofar as these grounds relate to amending constitutional provisions, they bear an impact on criminal procedural texts. This study will be confined to the most significant of these grounds, namely: the ground related to procedural criminal justice, given its governing role over criminal procedural provisions; and the second ground, which concerns enhancing confidence in criminal procedural texts. Accordingly, this study is divided into two sections: the first addresses the realization of procedural criminal justice, while the second focuses on strengthening confidence in the criminal procedural system.
