GOVERNANCA DE DADOS PESSOAIS DE CONSUMIDORES NO COMERCIO ELETRONICO NO VIETNA

Resumo: Este artigo examina a governanca de dados pessoais de consumidores no setor de comercio eletronico no Vietna. O estudo parte do pressuposto de que a rapida expansao da economia digital vietnamita intensificou a coleta, o tratamento e a circulacao de dados pessoais em plataformas digitais, ampliando riscos de vazamento, uso indevido e transferencia internacional sem controle suficiente. Com base em analise dogmatica do direito vietnamita e em dialogo comparado com o Regulamento Geral de Protecao de Dados da Uniao Europeia, o artigo demonstra que o Vietna avanca de um modelo fragmentado de tutela da privacidade para um regime mais estruturado de governanca de dados. Apesar desse progresso, persistem problemas de coerencia normativa, capacidade fiscalizatoria, definicao de competencias sancionatorias e efetividade dos direitos de controle do titular. Ao final, o texto propoe aperfeicoamentos legislativos e institucionais destinados a reforcar a responsabilizacao das plataformas, a efetividade das sancoes e a confianca dos consumidores no mercado digital.
