FROM LEGAL CERTAINTY TO POLITICAL REALITY: NON-COMPLIANCE WITH ADMINISTRATIVE COURT DECISIONS IN VILLAGE GOVERNANCE

Resumen

Legal certainty is a fundamental principle of the rule of law and should be guaranteed through final and binding decisions of the State Administrative Court (PTUN). However, in practice, PTUN decisions are often not implemented by public officials, particularly village heads. This study examines the non-compliance of village heads with PTUN decisions within village administration by analyzing the interaction between administrative law norms and local political dynamics. Using a normative-empirical approach, this research analyzes legislation, legal doctrines, and legally binding PTUN decisions, complemented by a case study on the dismissal of village officials in Cirebon Regency through interviews and documentation. Qualitative analysis reveals two main causes of non-compliance: structural legal weaknesses, especially the lack of effective enforcement mechanisms, and local political factors such as post-election rivalry, patronage, and power interests. These conditions undermine legal certainty, good governance principles, and the authority of PTUN. The study highlights the need for regulatory reform, stronger enforcement instruments, sanctions for non-compliant officials, and enhanced supervision to uphold the rule of law at the village level.
