Resumen

A questão da justiça constitui um tema clássico da teoria do direito. O presente artigo se propõe verificar como tal questão foi tratada nas obras de dois grandes pensadores do direito no século XX: Hans Kelsen e Niklas Luhmann. O objetivo será averiguar como os dois autores relacionam direito e justiça, para apontarmos, em seguida, que respostas os mesmos conferem à pergunta: o direito precisa da justiça?
