Abstract

This study examines the challenges faced by external oversight bodies in overseeing maladministration during police investigations, a critical stage in the criminal justice process that directly impacts legal certainty and human rights. It analyzes the nature and forms of maladministration in investigative practices and evaluate the institutional, legal, and structural barriers that limit the effectiveness of external administrative oversight. Using empirical legal research with a sociological-legal approach, this study combines primary data and secondary data. The analysis employs qualitative descriptive and analytical methods to identify recurring patterns of administrative violations, institutional resistance, and gaps between normative authority and practical implementation. The novelty of this study lies in the practical operation of external oversight in the investigative phase of criminal proceedings, highlighting the systemic rather than individual dimensions of maladministration. Findings indicate that maladministration is deeply rooted in broad investigative discretion, weaknesses in the enforcement of oversight recommendations, and an organizational culture resistant to external accountability. This study emphasizes the need for clearer boundaries of authority, stronger follow-up mechanisms, and an integrated accountability framework to enhance oversight effectiveness. These findings contribute to the development of more accountable, transparent, and rights-oriented investigative practices in the criminal justice system.
