REVISING THE CONCEPT OF HEARINGS THROUGH THE “PROCEEDINGS DISMISSAL” MECHANISM FOR THE RESOLUTION OF CONSUMER DISPUTES AT THE CONSUMER DISPUTE RESOLUTION BOARD (BPSK)

The objective of this study is to propose a conceptual update to the consumer dispute resolution process at the Consumer Dispute Resolution Agency (BPSK) by adopting the hearing procedures of the Administrative Court (PTUN), specifically the “Dismissal Process” at the initial stage of the hearing—a feature not found in other judicial institutions. This study was conducted using a qualitative descriptive approach and analyzed through primary data sources from a literature review, wherein the researcher examined data from regulations, books, and journals. The study employed an approach focused on legal regulations and a conceptual framework. The research findings indicate that the Dismissal Process implemented at the BPSK operates effectively because it provides legal certainty for consumers seeking justice. This includes changes in the BPSK’s trial proceedings that incorporate the dismissal process. Without this process, consumers would remain subject to initial rulings lacking legal justification. This is necessary because the BPSK is expected to be able to implement the initial stage of the Administrative Court (PTUN) proceedings, as many consumers are still rejected by the BPSK without legally sound legal considerations. The existence of this dismissal process will certainly have an impact on consumers filing complaints, thereby realizing legal certainty and legal justice.
