FUNDAMENTAL RIGHT TO THE ENVIRONMENT AS A CONSTITUTIVE ELEMENT FOR DEMOCRACY

Abstract

This paper aims to demonstrate how the fundamental right to the environment is presented as a precondition for the construction of the democratic state. This shall be presented initially a discussion about the concept of democracy, in order to show that in the XXI century, democracy can no longer be seen as a limited right of political participation, and should be understood as the ability that everyone has to build their own reality. In this context, the fundamental right to the environment represents and incorporates a number of elements minimum conditions for a dignified life, without which is impractical to talk about construction of reality itself. Finally, pick up will support as the relationship between environment and democracy occurs in a narrow way and appears to be essential to the establishment of design of any democratic state.
