Abstract

The capitalist model and free enterprise, prevailing in Brazil, have brought some sequels to the workers, what is worrisome, because there is a risk that, in the near future, according to an army of invalids from our jobs. This, the objective of this research is to analyze the responsability  civil the employer, by virtue of adquired diseases in the working environment; because in the face of this worrying reality is possible, through the integral risk theory (responsability objective), keep the discussion on fault; Since the obligation to indemnify will depend only of proving the event harmful and the causal relationship. Thus, pulled away the exclusionary of the responsibility. The working environment involves the lives of workers, so it is essential that ensure balance and decent working conditions. The methodology used in this research is inductive and qualitative about the purposes and, with regard to the means is bibliographic references.

Mestre e Doutor em Direito Ambiental pela Université de Limoges, França, com titulo revbalidado pela Univ. Federal de Pernambuco, professor adjunto do Mestrado em Direito Ambiental da Universidade do Estado do Amazonas e prof. Adjunto da Univ. Federal do Amazonas. Disciplina que ministra : 1) Biodireito : Biossegurança e Bioética; 2) Direito Ambientral na Ordem Tributária; Direito Ambiental do Trabalho.
