RIGHTS OF NATURE’S CONTRIBUTION TO THE CONSTRUCTION OF MULTI-DIMENSIONAL DEVELOPMENT AND A NEW CIVILIZATIONAL PARADIGM

Abstract

This article reflects on the rights of nature’s contribution to the construction of multidimensional development and a new civilizational paradigm. To do so, it presents a discussion about the origin of the rights of nature; a legal panorama of the rights of nature in Latin America, as well as a reflection on environmental neoconstitutionalism; the legal guarantees on the right to development; and the converging aspects between the rights of nature and multidimensional development. The choice of theme is justified by the fact that the effective protection of nature has a close relationship with the analyzed development in a variety of ways. As a result, it is possible to infer that the effective guarantee and regulation of the rights of nature can in fact establish a paradigm shift in society and contribute to the composition of a new civilizational framework, in which nature will be seen as a subject of law and not as a mere generator of resources for economic exploitation, as well as being able to contribute, in a sustainable and balanced way, to a multidimensional, holistic development. To achieve this objective, inductive methods will be used, supported by bibliographical and documentary research.
