Abstract

From the reading of the Papal Encyclical Laudato Si has aimed to demonstrate that the human relationship with the environment is inseparable assumption of the universal concept of human rights. Therefore, to use as a methodology, the research of the principles of environmental law and dichotomous discussion between anthropocentrism and biocentrism, in order to determine the limits (and actually there) solidarity and fraternity, as rights-guarantees for an effective and essential protection of the ecologically balanced environment and a healthy quality of life for present and future generations. At this point, it has been collate methodology and reference the principles of environmental law, especially the principle of an ecologically balanced environment and sustainable development, beginning the cosmopolitan vision of human rights from the design of multigenerational rights, in order to show the objective of this article, there is real relationship between environmental protection and development and meeting the spiritual being (this is not in the religious sense, but of existential quest for dignified life or abundance) and protection of fundamental rights, regardless of biocentric or anthropocentric view that wants to provide the environmental law.

Leandro de Marzo Barreto, UNIMEP

Defensor Público do Estado de São Paulo, desde 2007. Especialista em Direito do Estado e Relações Privadas, pela Universidade Dom Bosco de Mato Grosso do Sul (2003-2004). Especializando em Direito e Assistência Jurídica, pelo Instituto de Desenvolvimento e Democracia (IDDE) e Mestrando em Direitos Humanos e Fundamentais, pela Universidade Metodista (UNIMEP).

Paulo Affonso Leme Machado, UNIMEP

Graduação em Direito pela Pontifícia Universidade Católica de Campinas (1961), e mestrado em Direito Ambiental pela Universidade "Robert Schuman", Estrasburgo, França (1978). Recebeu título de doutor "Honoris causa", por notório saber jurídico-ambiental, pela Universidade Estadual Paulista Júlio de Mesquita Filho (1996) e pela Vermont Law School. South Royalton, Estado de Vermont, Estados Unidos da América (2013). É doutor em Direito pela Pontifícia Universidade Católica de São Paulo (2006), e Pós-Doutor pela Universidade de Limoges (França), tendo realizado pesquisas em ?Ressources en eau et droit international?, sob a supervisão do Prof. Dr. Gerard Monnediaire, Diretor do ?Centre de Recherches Interdisciplinaires en Droit de L´Environnement, de l´Aménagement et de l´Urbanisme ? CRIDEAU?(2007). Atualmente é professor titular da Universidade Metodista de Piracicaba (UNIMEP). Tem experiência na área de Direito, com ênfase em Direito Ambiental nacional e internacional, atuando principalmente nos seguintes temas: recursos hídricos, constituição federal e meio ambiente, direito à informação e meio ambiente. Premiações recentes: Medalha Mérito Ambiental/2009, concedida pelo IBAMA (2009). Diploma Chico Mendes de Ecologia e Meio Ambiente ? Câmara Municipal de Piracicaba, (2009). Homenageado pelo Superior Tribunal de Justiça da Cidade Autônoma de Buenos Aires - Argentina (2009). Chevalier de La Légion d´ Honneur, título concedido pelo Governo da França (2011).
