Competência Legislativa Ambiental e Aplicação da Norma Mais Restritiva Como Forma de Resolução de Conflitos: uma Análise Crítica

Abstract
O artigo discorre acerca das competências legislativas ambientais com vistas a discutira relevância do critério que aponta a observância da legislação mais restritivaao meio ambiente em caso de conflito normativo. Para tanto, elucida sobre aevolução da atenção jurídica ao tema ambiental, abordando a sua inserção naConstituição Federal de 1988. Discorre, em seguida, quanto ao modelo federativoadotado pela Carta Constitucional e ao sistema de repartição de competênciasentre União, Estados, Municípios e Distrito Federal. A partir disso, analisa osditames constitucionais que conferem a tais entes a competência legislativa paraproteger o meio ambiente e discute, a partir da doutrina, conceitosconstitucionais que envolvem o tema. Feita tal avaliação, traz os argumentosda doutrina que entende pela prevalência da norma mais protetiva, e introduzentendimentos doutrinários e jurisprudenciais que afastam tal critério, tomandopor base conceitos de competência formal e material.

Abstract
The article discusses about the environmental legislative competences in order to deliberate the relevance of the criterion which states the application of the more restrictive environmental legislation in the case of normative conflict. For this purpose, elucidates the evolution of legal attention to environmental issues, addressing its inclusion in the Constitution of 1988. Discourses not only on the federal model adopted by the Constitution of 1988, but also on the system of division of competences between federal entities. From this, analyzes the constitutional dictates that give such entities legislative power to protect the environment and discusses, based on the doctrine, the constitutional concepts involving the subject. Made such an evaluation, presents the arguments of scholars who understand the prevalence of the more protective law. After this discussion, highlights doctrinal and jurisprudential understandings.
