Visualizou-se a história da legislação florestal no século XX e XXI e a coerência da concepção das florestas como bem comum de todos os habitantes do Brasil. O acolhimento da concepção da função social da propriedade rural na Constituição Federal de 1988 foi abordado em sua implementação. A partilha das competências, de forma concorrente, para legislar sobre florestas foi tratada como um fator de criação de normas gerais federais e normas suplementares nos Estados e nos Municípios. A legislação florestal brasileira de 2012 foi focalizada em três aspectos: área de preservação permanente, área de reserva legal e pagamento de serviços ambientais.

Abstract
This paper looks into the history of forest legislation in 20th and 21st centuries and the coherence of the conception of forests as a common good of all the inhabitants of Brazil. The acceptance of the conception of the social function of land ownership in the Federal Constitution of 1988 was approached in accordance to its implementation. Concomitantly, the division of powers to legislate on forests was treated as a factor for the creation of federal standards as well as additional states standards and municipal standards. The Brazilian forest legislation of 2012 focused on three aspects: Permanent preservation area, legal reserve and payment for environmental services.
