A Responsabilidade Civil por Danos Ambientais no Direito Brasileiro e Comparado: Teoria do Risco Criado Versus Teoria do Risco Integral

Abstract
O presente artigo analisa a responsabilidade civil no caso de danos ambientais no Brasil, fazendo um paralelo entre a Teoria do Risco Criado e Teoria do Risco Integral. Para isso, baseia-se nas construções doutrinárias e jurisprudenciais, além de debater sobre as excludentes de responsabilidade e sobre o nexo de causalidade. Faz ainda uma análise das legislações de alguns países, no que concerne à responsabilidade civil no âmbito ambiental, com o intuito de proporcionar uma visão sistêmica acerca do atual desenvolvimento da matéria no direito comparado.

Abstract
This article examines civil liability in the cases of environmental damage in Brazil, by comparing both Created Risk and Integral Risk Theories. In order to do so, it relies on doctrinal and jurisprudential constructions as well as it discusses the exemptions for legal responsibility and causality nexus. Furthermore, it analyses law in some countries regarding liability for environmental damage, in order to provide a systemic view on the current development of the subject in comparative law.
