THE PROTECTION OF THE ENVIRONMENT IN ARMED CONFLICTS
Main Article Content
Abstract
The research aims to analyze the normative set of International Humanitarian Law, focusing on the examination of norms aimed at protecting the environment, in order to highlight the interdisciplinarity between the aspects of International Human Rights Law, International Environmental Law and International Humanitarian Law, as well as demonstrate the effectiveness of the application of the referred environmental protection norms in the context of armed conflicts. As a result, the armed conflict gains great relevance, as it fits the classification of anthropic intervention, since they are acts of belligerence caused by human action that result in a degradation of environmental quality, causing various consequences to the environment and, by this can give rise to accountability for non-compliance with the Humanitarian Regulation. Within this perspective, this research will use the deductive scientific method, with a rationalist perspective as the only way to reach knowledge, resorting to the descending chain of reasoning, from general to particular analysis, through the use of syllogism.
