Abstract

Considerando as profundas modificações sociais e as alterações na concepção de ciência e de direito, o autor trabalha, em uma abordagem transdisciplinar, o problema da tensão entre democracia e constitucionalismo. Na análise, o autor, mantendo a sua tradição intelectual, critica a separação entre constitucionalismo e democracia, aponta situações de autoritarismo na práxis e na teoria constitucional, sustentando, enfim, um poder constituinte em construção, pela sociedade e na rua, um direito achado na rua.
