EL DERECHO AL JUEGO: LA PROMESA OLVIDADA DEL ARTÍCULO 31 DE LA CDN

Aunque consagrado en el Artículo 31 de la Convención de los Derechos del Niño (CDN), el derecho al juego sigue siendo uno de los derechos más ignorados en el derecho internacional de la infancia. Este artículo examina críticamente la marginación de dicho derecho por los Estados y por el Comité de los Derechos del Niño, órgano supervisor de la CDN. A partir de un análisis empírico de las Observaciones Finales y las Observaciones Generales del Comité, el estudio demuestra que este derecho raramente es abordado de manera sustantiva, pese a su base jurídica inequívoca y su importancia para el desarrollo infantil. De las 646 Observaciones Finales emitidas hasta enero de 2026, solo 132 (20 %) lo mencionan explícitamente, con frecuencia en términos superficiales. De las 26 Observaciones Generales adoptadas, únicamente 10 hacen referencia a él, y solo la Observación General N.º 17 está dedicada a este derecho. El artículo sostiene que tal descuido socava la indivisibilidad de los derechos del niño y tiene consecuencias graves para grupos vulnerables: niños refugiados, niños con discapacidad y quienes viven en contextos de pobreza o conflicto armado. El derecho al juego es, sin duda, el derecho más olvidado e infravalorado de la Convención.
