Abstract

This article, taking as a basis the international definition of human rights, deals with the working environment (Environmental modern Labour Law), addressing technical aspects of organization, implementation and monitoring of hygiene standards, health and safety. Examined the Brazilian system of the environment of work inserted in the list of human rights, we conclude the need for rigorous enforcement of rules in order to avoid damaging the health of workers.

Advogado e Parecerista, sócio do Escritório Stürmer, Corrêa da Silva, Jaeger & Spindler dos Santos Advogados, com sede em Porto Alegre/RS. Conselheiro Seccional da OAB/RS. Membro do Instituto dos Advogados do Rio Grande do Sul (IARGS). Bacharel em Direito pela Pontifícia Universidade Católica do Rio Grande do Sul (1989), Mestre em Direito pela Pontifícia Universidade Católica do Rio Grande do Sul (2000), Doutor em Direito do Trabalho pela Universidade Federal de Santa Catarina (2005) e Pós-Doutor em Direito pela Universidade de Sevilla (Espanha) (2014). Coordenador do Curso de Pós-Graduação - Especialização em Direito do Trabalho e Direito Processual do Trabalho da Faculdade de Direito da Pontifícia Universidade Católica do Rio Grande do Sul. Professor Titular de Direito do Trabalho nos Cursos de Graduação e Pós-Graduação (Especialização, Mestrado e Doutorado) na mesma Faculdade. Tem como principais áreas de atuação, o Direito Individual do Trabalho, o Direito Coletivo do Trabalho e o Direito Processual do Trabalho, e como principais linhas de pesquisa, a Eficácia e Efetividade da Constituição e dos Direitos Fundamentais no Direito do Trabalho e a Jurisdição, Efetividade e Instrumentalidade do Processo do Trabalho.
