Abstract

O presente artigo tem por objeto de estudo o problema do excesso, no âmbito do direito penal. O autor analisa seu tratamento pelo legislador brasileiro, sua natureza jurídica e sua sistematização no âmbito da legítima defesa; para tanto, retoma elementos históricos para a consideração do direito de defesa e estuda os elementos subjetivos do excesso.
