Abstract
This article deals with the history of the thesis of the legitimate defense of dignity as a justifying element of crimes against women and its presence as a presupposition of the Action for Non-compliance with Fundamental Precept No. 779 (ADPF 779/2020) of the STF. We sought to explore the analysis categories fundamental to the study, namely; the legal topography of the exclusions of illegality in Brazilian law and its doctrinal conceptualization was identified; and, finally, the impacts of ADPF 779 in the criminal sphere related to intentional crimes against the lives of women were exposed. The results are the object of a qualitative research, inductive and historical method. The context of the use of the defense thesis, which alleges the legitimate defense of honor and violent emotion as excluding and mitigating, insists on being reaffirmed, in legal practices, and this could be seen in the results of this research.
