ADMINISTRATIVE SUSTAINABILITY AS METANORM THE DILEMMA INVOLVING THE TRANSPORTATION ASSISTANCE IN THE FEDERAL MILITARY PUBLIC SERVICE

Abstract

This paper establishes the principle of Sustainable Development as a metanorm, in order to assess the possibility of paying the transportation assistance to military personnel who move on their own vehicles from home to work, and vice versa. Under this focus, the objective was to offer a new perspective on the issue: while the STJ's jurisprudence enabled the payment of the assistance in these conditions, the Armed Forces' organs consolidated the understanding that the payment would only be due in the travels that used public collective transport. As a methodology, was used the bibliographic investigation of the specialized doctrine that conceptualizes the highlighted principle; the main laws and regulations that deal about transportation assistance were also analyzed. It was possible to establish profound arguments especially on the economic, environmental and social aspects surrounding the payment of the assistance, using this method. In the end, it was possible to conclude that the position that best fits the precepts of social justice is to confer the payment of the transportation assistance to the federal military, even if they travel to work using private vehicles.
