Abstract
Of relevance, both nationally and internationally, Environmental Law is the source of the principles and mechanisms so that we can minimize the damage and negative impacts to the local and global environment. The principle of reparation studied here, gives us this assistance, bringing greater effectiveness in the effectiveness of sanctions for damage to the environment. This work aimed to investigate the applicability of the repair by analyzing its forms, seeking the presentation of the legislation related to it and its scope, identifying the destination given to the values of the monetary repairs, in order to justify its collection in the environmental area. To respond to these objectives, a bibliographic review was carried out based on doctrine, legislation and jurisprudence. The results point to an obligation to use resources from sanctions, both administrative and judicial, in the repair or restoration of the environmental damage caused and the maintenance of ecological balance, as determined by our Constitution.
