Os Atos Ilícitos Praticados no Âmbito do Reflorestamento no Norte de Minas Gerais e Alto Jequitinhonha: Estudo de Caso E Repercussão Penal

Resumo

O direito penal no Estado Democrático de Direito tem a função de proteger bens jurídicos imprescindíveis à comunidade. O direito ao meio ambiente ecologicamente equilibrado foi uma escolha do Poder Constituinte Originário, que passou a prever sanções em caso de condutas violadoras ao bem jurídico ambiente e que, em nível penal, foram reguladas com o advento da Lei nº 9.605/1998. Tal Lei prevê, em seu artigo 48, a proteção ambiental contra qualquer obstrução à regeneração natural de florestas e demais formas de vegetação, sendo este um delito permanente, já que sua consumação se protrai no tempo.  Assim, em se tratando de crime permanente, abarca condutas que se iniciaram antes de sua tipificação, caso a violação ao ambiente ainda não tenha cessado. Esse é o caso dos crimes ambientais perpetrados na década de 1970, com a implantação dos Distritos Florestais, no norte de Minas Gerais e no Vale do Jequitinhonha.

Abstract

The criminal law in a democratic state has the essential function of protecting legal interests to the community. The right to an ecologically balanced environment was a choice of the original constituent power, which now provides for penalties for violators and the legal environment and that, in criminal terms, were regulated with the enactment of Law n. 9.605/1998. This Act provides, in article 48, the environmental protection hamper the natural regeneration of forests and other forms of vegetation, this being a permanent offense, since its consummation protrudes in time. Thus, in the case of permanent crime, includes conduct that began before his typing, if the violation of the environment has not yet ceased. This is the case of environmental crimes perpetrated in the 1970s, with the implementation of Forest Districts in northern Minas Gerais and in Jequitinhonha Valley.
