COMBATING PIRACY AND DEFENDING COPYRIGHT: A COMPARATIVE ANALYSIS OF BRAZIL AND THE UNITED STATES

This article seeks to identify and compare the main and most efficient procedures for patenting intellectual property and the laws that ensure them with the Brazilian procedure, focusing on Brazilian guidelines and the effectiveness of United States copyright laws. Thus, the biggest problem to be developed will be to properly compare the legal reality of other countries to that of Brazil and not merely make a forced adaptation of such different realities, identifying a middle ground between a commercial plaster by excessive patenting and a society without stimulus cost-effective industrial improvements. The work aims to find real and effective ways to improve its patenting procedures by observing the international contexts that are most effective for its actors. Comparative Law will be the main tool for analyzing these procedures. With the theoretical-deductive approach method and the use of comparative law, logic, customs, common sense and factual-logical moderation, conclusions must be reached with due transparency, legitimate purpose and proportionality.
