A VARIAÇÃO DE BRASÍLIA NA REGULAÇÃO DA IA

O Efeito Bruxelas descreve como a União Europeia projeta seu padrão regulatório sobre mercados e legisladores estrangeiros, mas subteoriza a agência do receptor: explica por que o mundo se adapta ao padrão europeu, não como o receptor o recebe. O artigo testa essa lacuna no cotejo entre o AI Act (Regulamento (UE) 2024/1689) e o Projeto de Lei nº 2338/2023, complementado pelo Projeto de Lei nº 6237/2025. A metodologia é hipotético-dedutiva, com comparação funcionalista e histórica e análise documental de nove institutos, classificados por quatro operações de tradução jurídica submetidas a regras de decisão enunciadas antes da análise. Os resultados indicam padrão intracasos de variação: calibragem redutora no eixo sancionatório, calibragem ampliativa em avaliação de impacto e direitos, mutação no poder público e convergência independente na responsabilidade civil, do que decorrem predições falseáveis sobre o substitutivo em tramitação. A hipótese de retroalimentação normativa do Brasil sobre circuitos europeus não é corroborada no corpus examinado, resultado negativo e provisório porque a busca não alcançou os circuitos documentais internos do emissor. Conclui-se que a variação ocorre na recepção, sob limite reconhecido de caso único.
