A DEPOSIÇÃO DE DETRITOS ESPACIAIS NO OCEANO E A PROTEÇÃO DO AMBIENTE MARINHO

O artigo examina a compatibilidade jurídica da deposição deliberada de detritos espaciais no oceano, especialmente na região do Ponto Nemo, com o regime internacional de proteção do meio marinho aplicável às áreas além da jurisdição nacional. Utiliza abordagem qualitativa e método dedutivo, com pesquisa bibliográfica, documental e análise sistemática de tratados internacionais, jurisprudência e instrumentos normativos do direito espacial, do direito do mar e do direito internacional ambiental, para investigar se a ausência de disciplina específica no direito espacial caracteriza um vazio normativo quanto à destinação final de objetos espaciais. A análise demonstra que o silêncio do regime espacial não afasta a incidência das obrigações internacionais de prevenção, preservação e controle da poluição marinha previstas na Convenção das Nações Unidas sobre o Direito do Mar, no Protocolo de Londres e no Acordo BBNJ, nem dispensa a realização de avaliação prévia de impacto ambiental quando existirem riscos plausíveis de degradação do meio marinho. Evidencia, ainda, que o princípio da precaução, associado aos deveres de diligência, transparência, monitoramento e compartilhamento de informações, fornece parâmetros jurídicos para a governança da atividade diante das incertezas científicas existentes. Conclui que a deposição de detritos espaciais em áreas além das jurisdições nacionais não ocorre em espaço livre de regulação, devendo observar as obrigações ambientais internacionais aplicáveis. O estudo contribui ao demonstrar a necessidade de interpretação integrada entre o direito espacial e o direito do mar para disciplinar uma atividade cuja relevância tende a crescer com a expansão das operações espaciais.
