JUDICIALIZING LOCAL POLITICS: THE SUPREME COURT’S ROLE IN SAFEGUARDING EXECUTIVE DISMISSAL IN INDONESIA

This study examines the phenomenon of political judicialization in the impeachment mechanism for regional executives in Indonesia, as set out in Law Number 23 of 2014 concerning the Regional Government. Through the Right to Trial (HMP) case at the Supreme Court (MA), the subjective political accusations of the Regional People's Representative Council (DPRD) were transformed into justiciable legal disputes. Using doctrinal research methods, this study identifies an acute constitutional paradox. Unlike the Constitutional Court's decision on the impeachment of the President, the Supreme Court's decision is declarative-imperative-mechanical, requiring the execution of the dismissal without further political confirmation. However, this executory dominance is limited by a rigid temporal restriction in the form of a 30-day trial timeline, which risks superficial examination. The empirical analysis of the jurisprudence of the Supreme Court's State Administrative Chamber reveals the progressive deconstruction of the "reprehensible acts" clause through the formulation of the doctrine of the Integrity of Public Officials, which unites private morality and executive positions. On the other hand, this study confirms the Acting Regional Head (Pj.) 's immunity from the jurisdiction of HMP. Based on the doctrine of State Administrative Law, the power of the Acting Regional Head derives from the central government's bureaucratic mandate, not from political attribution, so his accountability is strictly subject to the corridors of executiveoversight.
