A nova técnica de engenharia genética CRISPR-Cas9 projeta benefícios e riscos de se manipular e alterar geneticamente organismos vivos, de forma a trazer características favoráveis a eles mesmos e aos seres humanos. Com abordagem interdisciplinar, envolvendo a Filosofia, o Direito, a Biossegurança e a Bioética, o artigo objetiva verificar quais as consequências que o uso da referida técnica pode trazer à natureza genética dos organismos, sobretudo dos pontos de vista ético e jurídico. Como referência jurídica e de Biossegurança, optou-se pela Lei brasileira n. 11.105/2005 e, como referência filosófica e bioética, abordou-se a controvérsia entre os pensadores alemães Jürgen Habermas e Peter Sloterdijk, que analisaram o tema da engenharia genética e do risco da eugenia. Trata-se de pesquisa teórico-bibliográfica, que emprega o raciocínio dedutivo sobre os impactos jurídicos-filosóficos do uso da técnica do CRISPR-Cas9. A prática da engenharia genética, apesar dos riscos, pode ser um procedimento inevitável diante do atual estágio de desenvolvimento humano e enfrentála com a compreensão das responsabilidades jurídica e bioética torna-se essencial.
A manipulação genética sempre esteve envolta em polêmicas bioéticas e jurídicas. No entanto, nos últimos anos uma nova técnica de engenharia genética tem prometido revolucionar os caros processos de alteração genética.
A técnica do CRISPR-Cas9 permite substituir fragmentos da cadeia de DNA por outros, corrigindo “falhas” genéticas ou inserindo caracteres benéficos em um determinado organismo.
A possibilidade de ter o controle sobre o genoma e as características genéticas dos organismos suscita a reflexão sobre os riscos de uma natureza projetada para os interesses humanos e, ainda, os riscos de práticas eugênicas quando essas alterações se voltam para o genoma humano.
A presente pesquisa apresenta um estudo interdisciplinar, envolvendo a Filosofia, o Direito, a Biossegurança e a Bioética no intuito de verificar como a técnica do CRISPR-Cas9 pode repercutir no que conhecemos como natureza genética dos organismos vivos, enfrentando os problemas éticos e jurídicos trazidos. A referência jurídica e de Biossegurança será a Lei brasileira n. 11.105/2005, que aborda as questões da manipulação e engenharia genéticas, tanto em células humanas quanto de outros organismos vivos.
Para refletir sob a perspectiva filosófica e bioética, o artigo utiliza a controvérsia entre os pensadores alemães Jürgen Habermas e Peter Sloterdijk, que analisaram o tema da engenharia genética e do risco da eugenia.
Trata-se, pois, de pesquisa teórico-bibliográfica, que emprega o raciocínio dedutivo dos impactos jurídicos-filosóficos do uso da técnica do CRISPR-Cas9.
Para tanto, inicia-se por uma exposição do que consiste a técnica do CRISPR-Cas9, em seus aspectos biológicos e biotecnológicos.
Em seguida, aborda-se o tratamento legal da Biossegurança no Brasil. Após contextualizar a Biossegurança e seu desenvolvimento, analisa-se alguns dispositivos da Lei n. 11.105/2005, pretendendo dar um panorama de seu tratamento jurídico, dando ênfase às normas referentes à manipulação e engenharia genéticas.
Por fim, confronta-se a técnica do CRISPR-Cas9 com a terapia gênica por meio de adenovírus ou retrovírus e faz-se uma exposição dos riscos das técnicas frente à Bioética.

As bactérias, portanto, teriam uma capacidade de recordar os vírus que já lhe infectaram, a partir do DNA desses vírus, que seriam incorporados aos CRISPRs das bactérias. Quando as bactérias eram atacadas novamente pelos vírus, elas estavam resistentes.

Mesmo antes da técnica CRISPR ser utilizada oficialmente na edição de embriões humanos nos Estados Unidos, vários cientistas assinaram um manifesto denominado
Many countries do not have explicit legislation in place permitting or forbidding genetic engineering in humans considering such research experimental and not therapeutic (see go.nature.com/uvthmu). However, in nations with policies regarding inheritable genetic modification, it has been prohibited by law or by measures having the force of law. This consensus is most visible in western Europe, where 15 of 22 nations prohibit the modification of the germ line. Although the United States has not officially prohibited germline modification, the US National Institutes of Health’s Recombinant DNA Advisory Committee explicitly states that it “will not at present entertain proposals for germ line alterations” (see go.nature.com/mgscb2) (
O fato de existirem legislações mais duras em países do ocidente europeu, abre uma maior possibilidade da manipulação genética em nível germinativo com a técnica CRISPR ocorrer nos demais países, como será visto posteriormente.
O manifesto de
Em 28 de outubro de 2016 a técnica CRISPR-Cas9 foi testada pela primeira vez em um ser humano. Uma equipe chinesa, liderada pelo oncologista Lu You, da Universidade de Sichuan, em Chengdu, modificou células com a técnica CRISPR para combater um câncer de pulmão em um paciente. O processo consistiu na retirada de células imunes do sangue do paciente, que foram manipuladas com o CRISPR-Cas9. Dessa forma, foi desativado (cortado) um determinado gene, que tem como função codificar a proteína PD-1. Tal proteína, eventualmente, prejudica a resposta imune das células, provocando a proliferação de cânceres. As células editadas foram cultivadas e seu número aumentado. Posteriormente, elas foram novamente injetadas no paciente. A esperança da equipe é que as células editadas sem o PD-1 ataquem o câncer (CIRANOSKI, 2016).
O tratamento descrito acima foi contra o câncer, entretanto, deve-se enfatizar que o método CRISPR-Cas9 tem sido aplicado ao estudo de diversas doenças, pelo fato de poder reverter mutações ou trocar um gene danificado por outros saudáveis, ainda que existam doenças que, por enquanto, não sejam potencialmente tratadas pelo CRISPR-Cas9:

Os ganhos com o CRISPR-Cas9 e o impacto real de sua técnica contribuíram para que as
Genome editing holds great promise for preventing, ameliorating, or eliminating many human diseases and conditions. Along with this promise comes the need for ethically responsible research and clinical use.
RECOMMENDATION 2-1. The following principles should undergird the oversight systems, the research on, and the clinical uses of human genome editing:
1. Promoting well-being
2. Transparency
3. Due care
4. Responsible science
5. Respect for persons
6. Fairness
7. Transnational cooperation (
Esses princípios, por sua vez, vão resultar em responsabilidades para a edição do genoma humano. A seguir, explica-se cada um dos princípios elencados e suas respectivas responsabilidades atreladas.
Promoção do bem-estar: deve-se sempre buscar o benefício (princípio da beneficência) e a prevenção dos danos (princípio da nãomaleficência) dos envolvidos nas pesquisas → As responsabilidades procedidas são: a) usar a edição de genoma humano para tratamentos ou prevenção de doenças e não aplica-la em casos de grande incerteza; b) buscar os benefícios tendo também em vista os riscos envolvidos. Transparência: deve-se dar informações aos interessados de forma clara e compreensível → As responsabilidades procedidas são: a) comprometimento com a exposição do maior número de informações e de maneira célere; b) ceder informações para a construção de políticas públicas. Devido cuidado: deve-se ter um cuidado com os envolvidos, agindo somente baseado em firmes evidências → A responsabilidade procedida é: agir com precaução e frequente reavaliação das ações, levando também em conta as opiniões culturais. Ciência responsável: deve-se agir baseado somente em altos padrões de pesquisa, seguindo as diretrizes de normas internacionais e profissionais. → As responsabilidades procedidas são: a) fazer pesquisa de alto padrão; b) revisar e avaliar as pesquisas seguindo os protocolos; c) ser transparente; d) corrigir informações equivocadas. Respeito pelas pessoas ( Equidade: deve-se tratar os casos semelhantes da mesma maneira e praticar a justiça distributiva em relação aos riscos e benefícios. As responsabilidades procedidas são: a) fazer a distribuição de tarefas e benefícios das pesquisas; b) possibilitar o acesso universal e equitativo dos benefícios alcançados pelas investigações. Cooperação transnacional: deve haver uma colaboração internacional de pesquisa, levando-se em consideração os diferentes contextos culturais. As responsabilidades procedidas são: a) ter respeito pelas diferentes políticas nacionais; b) buscar normas comuns; c) partilhar dados alcançados.
Provavelmente, o relatório incentivou que pesquisas com embriões fossem realizadas nos Estados Unidos com a técnica CRISPRCas9. Alguns meses depois, isso se confirmou através de uma investigação que envolveu pesquisadores de diferentes nacionalidades e liderados por Shoukhrat Mitalipov, pesquisador da

No final de 2018, um experimento usando a técnica CRISPR-Cas9 faria um tumulto no meio científico: um pesquisado chinês, He Jiankui, de Shenzhen, anunciou que implantou embriões manipulados com a técnica CRISPR-Cas9, o que resultou no nascimento de duas meninas gêmeas, que seriam, portanto, os primeiros humanos nascidos editados geneticamente. Sua pesquisa consistiu em desabilitar um gene, denominado CCR5, que permite o acesso do vírus da Aids (HIV) em uma célula. Sua justificativa foi a de tornar os organismos resistentes à doença, muito comum na China e de que os filhos concebidos não tivessem a doença dos progenitores (ele usou pais com HIV e mães sem o vírus). O método consistiu em:
The gene editing occurred during IVF, or lab dish fertilization. First, sperm was “washed” to separate it from semen, the fluid where HIV can lurk. A single sperm was placed into a single egg to create an embryo. Then the gene editing tool was added.
When the embryos were 3 to 5 days old, a few cells were removed and checked for editing. Couples could choose whether to use edited or unedited embryos for pregnancy attempts. In all, 16 of 22 embryos were edited, and 11 embryos were used in six implant attempts before the twin pregnancy was achieved, He said.
Tests suggest that one twin had both copies of the intended gene altered and the other twin had just one altered, with no evidence of harm to other genes, He said. People with one copy of the gene can still get HIV, although some very limited research suggests their health might decline more slowly once they do (
Houve sérias dúvidas da comunidade científica de que a pesquisa tenha ocorrido, já que ela não saiu em qualquer revista científica que pudesse ser analisada por outros pesquisadores. Ocorreram também questionamentos sobre a forma como He Jiankui recrutou os participantes da pesquisa, já que talvez não tivesse sido claro quanto ao método empregado. Alguns cientistas questionaram o fato de que a edição do gene CCR5 poderia também possibilitar o surgimento de outras doenças. Não estava claro também se o pesquisador procedeu de maneira correta perante os órgãos competentes e as instituições envolvidas. Há ainda o questionamento de que existem pessoas cujo organismo sofre uma mutação natural no gene CCR5, que os torna imunes ao HIV e que, por isso, o teste feito teria como justificativa implícita a pura e simples aplicação da técnica (
O suposto experimento gerou uma reação em cadeia. Vários cientistas criticaram o fato dele ter sido feito sem ainda haver um consenso no meio científico sobre a edição genética em seres humanos e sua implantação. Na própria China, país de origem do autor da pesquisa, onde há autorização para a edição genética, um grupo de 122 cientistas escreveu uma carta aberta em que chamam He Jiankui de louco e afirmam que tal atividade foi um duro golpe na reputação e no desenvolvimento científico da China (
Os incipientes experimentos envolvendo a técnica CRISPRCas9 levantam problemas de segurança e ética nos procedimentos de manipulação genética.
Certo é que há riscos ainda desconhecidos e a Biossegurança deve atuar na prevenção desses riscos internos (laboratoriais) e externos (na liberação dos organismos modificados).
A Biossegurança é o conjunto de técnicas e procedimentos que atua junto às pesquisas com material biológico, buscando a prevenção, a eliminação ou a diminuição dos riscos à saúde humana e ao meio ambiente, bem como a manutenção do equilíbrio dos ecossistemas.
Na atuação junto à biotecnologia, pode-se afirmar que a Biossegurança é mais pragmática que a Bioética, porque objetiva implementar procedimentos de segurança, que devem abranger atividades de investigação, ensino, produção e distribuição de inventos e de produtos biotecnológicos, bem como o desenvolvimento e a prestação de serviços relacionados à biotecnologia.
O marco inicial da biossegurança contemporânea está nas reuniões de Asilomar, na Califórnia, onde em 1975 ocorreu uma série de reuniões, envolvendo importantes cientistas que discutiam sobre a ética na pesquisa. O assunto mais relevante, naquele momento, foi a sugestão de moratória de pesquisas genéticas, ocorrida no ano anterior por uma parcela de cientistas.
Por meio dessa reunião foram estabelecidas diretrizes para a segurança dos experimentos com DNA recombinante. Apesar da expressão “biossegurança” não ter sido utilizada na época, foi o documento de Asilomar que lançou as bases da biossegurança.
Hoje, os procedimentos de biossegurança ocupam-se principalmente de:
Identificar os riscos de atividades que envolvam manuseio de material biológico; Caracterizar os riscos segundo a probabilidade de seus efeitos e o alcance de suas possíveis consequências; Analisar níveis de exposição aceitáveis a materiais perigosos ou com riscos ainda desconhecidos; Avaliar a probabilidade dos efeitos negativos da atividade; E, em caso de danos, avaliá-los e propor medidas de contenção e reparação.
No Brasil, o principal instrumento regulador da Biossegurança é a Lei n. 11.105 Lei de Biossegurança sancionada pelo Presidente da República em 24 de março de 2005.
Como aspectos gerais, a Lei de Biossegurança estabelece normas de segurança e mecanismos de fiscalização sobre construção, cultivo, produção, manipulação, transporte, transferência, importação, exportação, armazenamento, pesquisa, comercialização, consumo, liberação no meio ambiente e descarte de organismos geneticamente modificados, tendo como diretrizes o estímulo ao avanço científico na área de biossegurança e biotecnologia, a proteção à vida e à saúde humana, animal e vegetal, e a observância do princípio da precaução para a proteção do meio ambiente (
A Lei de Biossegurança trata, como temas centrais, da pesquisa com células-tronco embrionárias e da pesquisa e liberação de organismos geneticamente modificados. No entanto, ela também cria restrições a manipulações genéticas.
A tramitação da Lei foi tumultuada, com pressão de grupos econômicos interessados na modificação genética de soja, até então desregulamentada. Foi durante a tramitação que o Presidente da República assinou a Medida Provisória n. 223, de 14 de outubro de 2004 mais tarde convertida na Lei n. 11.092, de 12 de janeiro de 2005 -, liberando o plantio da soja transgênica da safra 2004-2005 e a comercialização do produto até 31 de janeiro de 2006.
Após a promulgação da Lei, outra celeuma se instaurou com relação à pesquisa com células-troncos embrionárias. Em 30 de maio de 2005, o então Procurador-Geral da República, Cláudio Fonteles, protocolizou petição questionando a constitucionalidade do artigo 5º da Lei de Biossegurança, que permite a utilização de embriões humanos excedentes das técnicas de fertilização
O Procurador-Geral da República mostrou-se indignado com o tratamento normativo dado ao embrião humano crioconservado, excedente de fertilização
Sob o argumento de que “
O julgamento da ADI n. 3.510-0 iniciou-se em março de 2008, ocasião em que se manifestaram pela constitucionalidade do artigo 5o o Ministro Relator Dr. Carlos Ayres de Britto e a então Presidente do Supremo Tribunal Federal, Ministra Ellen Gracie. A seção foi suspensa em razão de pedido de vista do Ministro Carlos Alberto Menezes Direito. Retomado o julgamento em 28 de maio de 2008, os Ministros Menezes Direito e Ricardo Lewandowski votaram pela parcial procedência do pedido de inconstitucionalidade do artigo 5º da Lei de Biossegurança. A Ministra Cármen Lúcia Rocha e o Ministro Joaquim Barbosa julgaram-no improcedente. Pela improcedência manifestaram, também, os Ministros Eros Grau e Cezar Peluso, porém, com determinadas ressalvas, nos termos dos seus votos. O julgamento foi suspenso e retomado no dia seguinte, 29 de maio de 2008. Colhidos os votos dos demais Ministros (Min. Celso Mello, Min. Marco Aurélio e Min. Gilmar Mendes) (
Enfim, o Supremo Tribunal Federal, por maioria e nos termos do voto do Relator, julgou improcedente o pedido constante na Ação Direta de Inconstitucionalidade n. 3.510-0, vencidos parcialmente, em diferentes extensões, os Ministros Menezes Direito, Ricardo Lewandowski, Eros Grau, Cezar Peluso e Gilmar Mendes, sendo então permitida a pesquisa com células-tronco embrionárias, especialmente a partir da diferenciação do tratamento jurídico dado ao nascituro daquele despendido ao embrião não gestado e congelado como excedentário de técnicas de reprodução humana assistida (
As pesquisas e terapias com embriões humanos são permitidas pela Lei de Biossegurança apenas quanto às células-tronco, sendo proibida qualquer técnica de engenharia genética, donde se pode inferir que também está proibida a técnica CRISPR-Cas9. O art. 24 tipifica como crime, e pune com detenção, de 1 a 3 anos, e multa, a conduta de utilizar embrião humano em desacordo com as disposições do art. 5º, ou seja, a utilização dos embriões deve observar os seguintes requisitos: a) a pesquisa e a terapia devem ter por objeto células-tronco; b) devem os genitores consentir expressamente na utilização; c) aprovação prévia dos comitês de ética em pesquisa das instituições de pesquisa e serviços de saúde envolvidos; e d) não se destinar à comercialização de material biológico (
Já a alteração genética em embrião recebeu tipificação própria, sendo crime punível com reclusão, de 1 a 4 anos, e multa (
Também é vedada a engenharia genética em célula germinal humana, o que foi incluído no tipo do art. 25, com as mesmas punições relativas ao embrião.
A proibição de engenharia genética em embriões e células germinativas humanas foi inserida com o objetivo de evitar uma possível eugenia, ou mesmo práticas abusivas e invasivas.

A clonagem é o processo de reprodução assexuada, produzida artificialmente, baseada em um único patrimônio genético, com ou sem utilização de técnicas de engenharia genética. Se for clonagem reprodutiva, o objetivo final será a obtenção de um novo indivíduo, geneticamente igual ao anterior. Se a clonagem for terapêutica, seu objetivo será a produção de células geneticamente idênticas que possam ser utilizadas em tratamento médico.
A clonagem está proibida por meio do artigo 26, que prevê punição de 2 a 5 anos de reclusão e multa para aquele que a realizar (
Em relação à saúde humana, a técnica CRISPR-Cas9 abre margem para o aprimoramento e a ampliação da terapia gênica, que consiste no tratamento de doenças, herdadas ou adquiridas, em que se manipulam os genes defeituosos a fim de alcançar a cura ou estagnação da anomalia.
Em teoria, a terapia gênica pode se realizar em células somáticas e células germinativas, embora nestas últimas o risco seja muito maior, pois a alteração dos gametas pode resultar alterações inesperadas, como malformações e doenças até então desconhecidas. Há, inclusive, o risco de gerar problemas recessivos que poderão se manifestar apenas em gerações futuras.
Antes da técnica CRISPR-Cas9, a terapia somática era realizada por um vetor, retrovírus ou adenovírus, que inseria o novo material genético nas células doentes. Os vírus atuam como vetores eficientes por possuírem uma programação genética que lhes leva a transferir seu material genético para o organismo infectado.
Alguns retrovírus e adenovírus possuem ampla capacidade de propagação de seu material genético sem destruição das células do organismo invadido. Na terapia somática, retira-se parte do genoma do vírus, mantendo sua capacidade de reprodução e transferência, e se insere o material genético saudável a ser transportado. Ao infectar as células do paciente, o vírus transfere o material genético que está portando para as células doentes do organismo, modificando sua estrutura (
Já a técnica do CRISPR-Cas9 não se utiliza de outro organismo, como o retrovírus ou o adenenovírus. O CRISPR é uma sequência de DNA que pode ser repetida diversas vezes, com sequências únicas entre as repetições, e que permite cortar o DNA em lugares específicos. O Cas9 é a enzima responsável por esse corte. Então, por meio de uma cadeia-guia de RNA, retira-se um pedaço do DNA cortado e o substitui por outro.
Aparentemente mais eficaz, a técnica do CRISPR-Cas9 seria mais precisa que a terapia por intermédio do vírus.
A ADA, que ocorre pela ausência de uma enzima, “desativa” o sistema imunológico, deixando o paciente vulnerável a qualquer doença.
Células do sistema imunológico das duas meninas foram colhidas e cultivadas em laboratório, e depois infectadas por retrovírus contendo o material genético desejado. O DNA do retrovírus foi transferido às células, que foram reinseridas nas pacientes. Várias infusões foram feitas durante alguns meses. Paralelamente à terapia gênica, as meninas foram submetidas à substituição enzimática, por exigência do

Posso atestar pessoalmente que Cutshall parecia uma menina muito saudável de onze anos quando ela e sua família visitaram Cold Spring Harbor, em 1992. Onze anos depois, porém, os resultados não se mostraram tão conclusivos. O funcionamento do sistema imunológico de DeSilva está próximo do normal, mas somente cerca de um quarto de suas células T proveio da terapia gênica. O sangue de Cutshall tem uma proporção ainda menor de células T provenientes da terapia, embora seu sistema imunológico também esteja funcionando bem. Contudo, é difícil dizer exatamente quanto dessa melhora se deve à terapia gênica e quanto é uma decorrência do tratamento enzimático contínuo. O resultado, pois, é ambíguo demais para ser interpretado como um sucesso inequívoco da terapia gênica (
Alguns problemas podem ser apontados nesse tipo de terapia, como demonstra o próprio caso de DeSilva e Cutshall. As células submetidas ao tratamento possuem pequeno tempo de vida, o que significa que o material genético sadio geralmente não consegue atingir a totalidade das células doentes. Também é clara a dificuldade em se atingir somente aquelas que necessitam do gene substituto. No caso de DeSilva e Cutshall, as células a serem tratadas podiam ser obtidas facilmente, por se tratarem de células do sistema imunológico.
Por fim, a terapia gênica somática apresenta incalculável potencial oncogênico. Pode-se perceber esse risco a partir de um caso ocorrido na França, em 2000. No Hospital Necker, de Paris, sob a chefia de Alain Fischer, dois bebês com ADA foram submetidos à terapia. A inovação ficou por conta da utilização de células-tronco da medula óssea dos bebês. Assim, quando as células-tronco se reproduzissem, gerariam automaticamente células com genes saudáveis, numa “correção genética autorregenerante.” (
Os resultados da terapia foram incríveis nos primeiros anos, mas em 2002, descobriu-se que um dos bebês apresentava quadro de leucemia. Embora o risco oncogênico seja real, no caso da ADA o resultado obtido ainda pode ser considerado vantajoso, em razão de suas características e dificuldades com tratamentos.
Esses riscos apresentados pela terapia gênica por meio de vírus, como o menor tempo de vida celular e o aumento do potencial oncogênico, podem também se manifestar na técnica CRISPR-Cas9, como relatado acima.

Assim, o espaço da Bioética nessa discussão deve ser ampliado para que permita entender que qualquer decisão a respeito da técnica CRISPRCas9 implicará em uma série de responsabilidades com as gerações presentes e futuras, sendo forçoso não escapar de suas interferências na natureza e consequências.
Invoca-se a Bioética Global como importante agente de reflexão em tema tão espinhoso, posto que Genética exige uma Bioética que se projeta “into the future leads even to a ‘subject’ who does not exist, does not claim and does not have his rights harmed: future generations. Moreover, it also addresses other forms of life, since ethics becomes a part of the philosophy of nature.” (
Não se pode afirmar com absoluta certeza que a técnica CRISPR-Cas9 irá se consolidar no meio científico. A ciência séria é feita paulatinamente por meio de provas, contraprovas, experimentos e discussões. Há, portanto, um longo caminho a percorrer. Entretanto, não se pode negar que o potencial da técnica é inegável.
O CRISPR-Cas9 tem a capacidade de adentrar inúmeras áreas práticas que vão desde a produção de alimentos, passando pela manipulação de populações animais, pela área de fármacos e, enfim, pela biotecnologia, com destaque para a manipulação em células germinativas e embriões. Os interesses econômicos, sociais, políticos e científicos fazem com que o assunto frequentemente seja abordado de maneira exaltada.
Depois de apresentar a técnica CRISPR-Cas9, do seu surgimento até o uso em embriões implantados, o artigo apresentou elementos da Lei de Biossegurança no Brasil. The new genetic engineering technique CRISPR-Cas9 projects benefits and risks of genetically manipulating and altering living organisms in order to bring about characteristics that are favorable to themselves and to humans. With an interdisciplinary method, involving Philosophy, Law, Biosafety and Bioethics, this paper aims to verify the consequences that the use of this technique can bring to the genetic nature of organisms, especially from the ethical and legal points of view. As a legal and biosafety reference, we opted for Brazilian Law n. 11.105/2005 and for philosophical and bioethical reference, we approach the controversy between the German thinkers Jürgen Habermas and Peter Sloterdijk, who analyzed the subject of genetic engineering and the risk of eugenics. It is a theoretical-bibliographic research, which uses deductive reasoning on the legal-philosophical impacts of the CRISPR-Cas9 technique. The practice of genetic engineering, despite the risks, may be an inevitable procedure in the present stage of human development and confronting it with an understanding of legal and bioethical responsibilities becomes essential.
Genetic manipulation has always been shrouded in bioethical and legal polemics. However, in recent years a new genetic engineering technique has promised to revolutionize the expensive genetic alteration processes.
The CRISPR-Cas9 technique allows the replacement of fragments of the DNA chain, correcting genetic “failures” or inserting beneficial characters into a given organism.
The possibility of having control over the genome and the genetic characteristics of the organisms raises the reflection on the risks of a nature projected for human interests and also the risks of eugenic practices when these changes are turned to the human genome.
The present research presents an interdisciplinary study, involving Philosophy, Law, Biosafety and Bioethics in order to verify how the CRISPR-Cas9 technique can affect what we know as the genetic nature of living organisms, facing the raised ethical and legal problems. The Biosafety juridic reference will be Brazilian Law n.11.105/2005, which addresses the issues of genetic engineering and manipulation, both in human cells and other living organisms.
To reflect from a philosophical and bioethical perspective, the article uses the controversy between the German thinkers Jürgen Habermas and Peter Sloterdijk, who analyzed the subject of genetic engineering and the risk of eugenics.
It is, therefore, a theoretical-bibliographic research, which employs the deductive reasoning of the legal-philosophical impacts on the use of the CRISPR-Cas9 technique.
To do so, it begins with an exposition of the CRISPR-Cas9 technique, in its biological and biotechnological aspects.
Next, it addresses the legal treatment of Biosafety in Brazil. After contextualizing Biosafety and its development, some provisions of Law n.11.105/2005 are analyzed, aiming to give an overview of its legal treatment, emphasizing the rules regarding genetic engineering and manipulation.
Finally, the CRISPR-Cas9 technique is confronted with gene therapy through adenovirus or retroviruses and an exposition is made regarding the risks of these techniques compared to Bioethics.
CRISPR is an acronym for the English term
The role of CRISPR will then be associated with a natural defense capacity of bacteria and archaea against viruses (
[...] bacteria and archaea would have sophisticated immune systems. After all, viruses are the most abundant biological agents on the planet, causing roughly infections every second. The selective pressures imposed by viral predation have resulted in the evolution of numerous phage defense systems, but it was only recently that sophisticated adaptive defense systems were identified in both bacteria and archaea (ERP et al., 2015, p. 85).
Such a hypothesis will be proven in 2007 by scientists of American, French and Canadian origin who worked for Danisco, a Danish food company. Researchers have started from the notion that many bacteria are used for fermentation and biotechnological processes of food, but that such bacteria are attacked by phages, which are often not neutralized by the usual processes (

The bacteria, therefore, would have an ability to remember the viruses that have already infected it, from the DNA of those viruses, which would be incorporated into the CRISPRs of the bacteria. When the bacteria were attacked again by the viruses, they were resistant.
Studies on bacteria would be just the beginning of the CRISPR analysis. From then on, a number of articles were devoted to it, although not understanding how the whole procedure involved occurred. It was already known, however, that the process for bacterial resistance depended on the actuation of RNA guiding molecules. One study found that RNA would be responsible for coordinating the recognition and destruction of viral infections, and that this would involve the CRISPR defense system. RNA molecules were produced by cells, through CRISPR, to fight the DNA sequences of the invading virus (

Even before the CRISPR technique was officially used in the edition of human embryos in the United States, several scientists signed a manifesto called
Many countries do not have explicit legislation in place permitting or forbidding genetic engineering in humans considering such research experimental and not therapeutic (see go.nature.com/uvthmu). However, in nations with policies regarding inheritable genetic modification, it has been prohibited by law or by measures having the force of law. This consensus is most visible in western Europe, where 15 of 22 nations prohibit the modification of the germ line. Although the United States has not officially prohibited germline modification, the US National Institutes of Health’s Recombinant DNA Advisory Committee explicitly states that it “will not at present entertain proposals for germ line alterations” (see go.nature.com/mgscb2) (
The fact that a tougher legislation exists in Western European countries opens up a greater possibility of genetic manipulation at germ level with the CRISPR technique to occur in other countries, as will be seen later.

On October 28, 2016 the CRISPR-Cas9 technique was first tested on a human. A Chinese team, led by oncologist Lu You of Sichuan University in Chengdu, has modified cells using the CRISPR technique to fight lung cancer in a patient. The procedure consisted in the removal of immune cells from the patient’s blood, which were manipulated with CRISPR-Cas9. Thus, a specific gene, which has the function of encoding the PD-1 protein, has been deactivated (cut). Such a protein eventually impairs the immune response of cells, causing the proliferation of cancers. The edited cells were cultured and their numbers increased. Subsequently, they were injected back into the patient. The team’s hope is that edited cells without PD-1 will attack cancer (CIRANOSKI, 2016).
The treatment described above was against cancer, however, it should be emphasized that the CRISPR-Cas9 method has been applied to the study of several diseases, by the fact that it can revert mutations or exchange a damaged gene for healthy ones, although there are diseases that, for the time being, are not potentially treated by CRISPR-Cas9:
Beyond cancer, HIV, and the genetic disorders discussed thus far, a quick survey of the published scientific literature reveals a growing list of diseases for which potential genetic cures have been developed with CRISPR: achondroplasia (dwarfism), chronic granulomatous disease, Alzheimer’s disease, congenital hearing loss, amyotrophic lateral sclerosis (ALS), high cholesterol, diabetes, Tay-Sachs, skin disorders, fragile X syndrome, and even infertility. [...] There are all sorts of disorders from autism to heart disease that don’t show significant genetic causation or are caused by a complex combination of genetic variants and environmental factors. In these cases, gene editing may be of more limited use (
The gains from CRISPR-Cas9 and the real impact of his technique contributed to the US
Genome editing holds great promise for preventing, ameliorating, or eliminating many human diseases and conditions. Along with this promise comes the need for ethically responsible research and clinical use.
RECOMMENDATION 2-1. The following principles should undergird the oversight systems, the research on, and the clinical uses of human genome editing:
1. Promoting well-being

These principles, in turn, will result in responsibility for editing the human genome. The following explains each of the listed principles and their respective responsibilities linked.
Promotion of welfare: one should always seek the benefit (principle of beneficence) and prevention of harm (principle of nonmaleficence) of those involved in the research → The responsibilities are: to use the human genome edition for treatments or prevention of diseases and does not apply it in cases of great uncertainty; b) seek the benefits also bearing in mind the risks involved. Transparency: Information should be given to stakeholders in a clear and comprehensible manner → The responsibilities are: a) commitment to exposing the greatest amount of information in a quickly manner; b) submit information for the construction of public policies. 3 Due caution: care should be taken with those involved, acting only on the basis of strong evidence → The responsibility is: to act with caution and frequent reassessment of actions, also taking cultural opinions into account. Responsible science: one should act based only on high standards of research, following the guidelines of international and professional norms → The responsibilities are: a) to conduct high-level research; b) review and evaluate researches following the protocols; c) be transparent; d) correct misinformation. Respect for persons: the dignity of all individuals should be acknowledged, respecting their particular decisions, and taking all individuals with the same moral value, regardless of their genetic properties → The responsibilities are: a) to have the same commitment to all; b) respect for decisions; c) prevent eugenic practices, such as those already practiced; d) destigmatize deficiencies. Equity: treat similar cases in the same way and practice distributive justice in relation to risks and benefits. The responsibilities are: a) to distribute research tasks and benefits; b) provide universal and equitable access to the benefits of the investigations. Transnational cooperation: there must be international research collaboration, taking into account the different cultural contexts. Responsibilities are: a) to respect the different national policies; b) seek common standards; c) share data achieved.

By the end of 2018, an experiment using the CRISPR-Cas9 technique would cause a riot in the scientific milieu: a Chinese researcher, He Jiankui, from Shenzhen, announced that he implanted embryos handled with the CRISPR-Cas9 technique, which resulted in the birth of two girls which would be the first genetically engineered human born. His research consisted of disabling a gene, called CCR5, which allows access to the HIV virus in a cell. His justification was to make organisms resistant to the disease, very common in China, and that the offspring did not have parental disease (he used parents with HIV and mothers without the virus). The method consisted of:
The gene editing occurred during IVF, or lab dish fertilization. First, sperm was “washed” to separate it from semen, the fluid where HIV can lurk. A single sperm was placed into a single egg to create an embryo. Then the gene editing tool was added.
When the embryos were 3 to 5 days old, a few cells were removed and checked for editing. Couples could choose whether to use edited or unedited embryos for pregnancy attempts. In all, 16 of 22 embryos were edited, and 11 embryos were used in six implant attempts before the twin pregnancy was achieved, He said.

The incipient experiments involving the CRISPR-Cas9 technique raise safety and ethical issues in genetic manipulation procedures.
Certain risks are as yet unknown and Biosafety must act to prevent these internal (laboratory) and external (in the release of modified organisms) risks.
Biosafety is the set of techniques and procedures that works together with research on biological material, seeking the prevention, elimination or reduction of risks to human health and the environment, as well as maintaining the balance of ecosystems.
In its work with biotechnology, it can be said that Biosafety is more pragmatic than Bioethics because it aims to implement safety procedures which should cover activities of investigation, teaching, production and distribution of inventions and biotechnological products, as well as development and the provision of services related to biotechnology.
The earliest landmark of contemporary biosafety is at meetings in Asilomar, California, where a series of meetings took place in 1975 involving leading scientists who discussed ethics in research. The most relevant issue at that time was the suggestion of a moratorium on genetic research, which occurred in the previous year by a group of scientists.
Through this meeting guidelines were established for the safety of experiments with recombinant DNA. Although the term “biosafety” was not used at the time, it was the Asilomar document that laid the foundations for biosafety.
Today, biosafety procedures are mainly concerned with:
Identify the risks of activities involving the handling of biological material; Characterize the risks according to the probability of their effects and the extent of their possible consequences; Analyze acceptable levels of exposure to hazardous materials or materials with risks as yet unknown; Evaluate the probability of the negative effects of the activity; And in case of damage, evaluate it and propose measures of containment and repair.
In Brazil, the main regulatory instrument of Biosafety is Law n. 11.105 Lei de Biossegurança (Biosafety Law) sanctioned by the President of the Republic on March 24, 2005.
As a general matter, the Biosafety Law establishes safety standards and inspection mechanisms for construction, cultivation, production, handling, transportation, transfer, import, export, storage, research, marketing, consumption, release into the environment and disposal of genetically modified organisms, with guidelines to stimulate scientific advances in the area of biosafety and biotechnology, protection of human, animal and plant life and health, and observance of the precautionary principle for the protection of the environment (
The Biosafety Law addresses, as central themes, embryonic stem cell research and the research and release of genetically modified organisms. However, it also creates restrictions on genetic manipulation.
The Law processing was rough, with pressure from economic groups interested in the genetic modification of soy, hitherto deregulated. It was during the procedure that the President of the Republic signed Provisional Measure n. 223, dated October 14, 2004 later converted into Law n.11.092, of January 12, 2005 -, legalizing the planting of transgenic soybean from the 2004-2005 harvest and the commercialization of the product until January 31, 2006.

The ADI trial n. 3510-0 began in March 2008, when the Reporting Minister Carlos Ayres de Britto and the then President of the Federal Supreme Court, Minister Ellen Gracie, voiced on the constitutionality of Article 5. The section was suspended due to the request of the Minister Carlos Alberto Menezes Direito. Resuming the trial on May 28, 2008, Ministers Menezes Direito and Ricardo Lewandowski voted for partial submission of the request for unconstitutionality of article 5 of the Biosafety Law. Minister Carmen Lúcia Rocha and Minister Joaquim Barbosa deemed it unfounded. For its dismissal, Ministers Eros Grau and Cezar Peluso also stated, with certain reservations, in the terms of their votes. The trial was adjourned and resumed the next day, May 29, 2008. Research and therapies with human embryos are allowed by the Biosafety Law only regarding stem cells, and any technique of genetic engineering is prohibited, from which it can be inferred that the CRISPRCas9 technique is also prohibited. The art. 24 criminalizes and punishes with imprisonment, from 1 to 3 years, and fine, the conduct of using human embryo in disagreement with the provisions of art. 5, that is to say, the use of embryos must comply with the following requirements: a) research and therapy should have stem cells as object; b) the parents must expressly consent to the use; c) prior approval of the research ethics committees of the research institutions and health services involved; and (d) is not intended for the marketing of biological material (
On the other hand, the embryo genetic alteration received its own classification, being a crime punishable by imprisonment, from 1 to 4 years, and a fine (
Genetic engineering in human germ cell is also prohibited, which has been included in the art. 25, with the same punishments related to the embryo.
The prohibition of genetic engineering in embryos and human germ cells has been inserted with the aim of avoiding possible eugenics, or even abusive and invasive practices.
Finally, the Biosafety Law prohibits human cloning, in any of its forms, be it reproductive or therapeutic (
Cloning is the process of asexual reproduction, artificially produced, based on a single genetic patrimony, with or without the use of genetic engineering techniques. If it is reproductive cloning, the ultimate goal will be to obtain a new individual, genetically the same as the previous one. If the cloning is therapeutic, its objective will be the production of genetically identical cells that can be used in medical treatment.
Cloning is prohibited through article 26, which provides for punishment of 2 to 5 years of imprisonment and a fine for the one who performed it (
In relation to human health, the CRISPR-Cas9 technique opens the door to the improvement and expansion of gene therapy, which consists in the treatment of diseases, inherited or acquired, in which defective genes are manipulated in order to achieve cure or stagnation of the anomaly.
In theory, gene therapy can be performed on somatic cells and germ cells, although in the latter the risk is much greater, since the alteration of gametes can result in unexpected changes, such as malformations and diseases hitherto unknown. There is even the risk of generating recessive problems that may only manifest themselves in future generations.
Before the CRISPR-Cas9 technique, somatic therapy was performed by a vector, retrovirus or adenovirus, which inserted new genetic material into diseased cells. Viruses act as efficient vectors by having a genetic programming that leads them to transfer their genetic material to the infected organism.
Some retroviruses and adenoviruses have ample capacity of propagation of their genetic material without destruction of the cells of the invaded organism. In somatic therapy, part of the virus’s genome is removed, maintaining its reproductive and transfer ability and inserting healthy genetic material to be transported. By infecting the patient’s cells, the virus transfers the genetic material it is carrying to diseased cells of the body, modifying its structure (
The CRISPR-Cas9 technique does not use another organism, such as the retrovirus or the adenovirus. CRISPR is a DNA sequence that can be repeated several times, with unique sequences between the repeats, and allows to cut the DNA in specific places. Cas9 is the enzyme responsible for this cut. So, through an RNA guiding chain, one piece of the cut DNA is removed and replaced with another.
Apparently more effective, the CRISPR-Cas9 technique would be more accurate than virus therapy.
Immune system cells from both girls were harvested and cultured in the laboratory, and then infected with retroviruses containing the desired genetic material. The retrovirus DNA was transferred to the cells, which were reinserted into the patients. Several infusions were made for a few months. In parallel to gene therapy, the girls were submitted to enzyme replacement, as required by the National Institutes of Health.
Watson and Berry report the results:
I can personally attest that Cutshall looked like a very healthy 11-year-old when she and her family visited Cold Spring Harbor in 1992.Eleven years later, however, the results were not as conclusive. The functioning of DeSilva’s immune system is close to normal, but only about a quarter of its T cells came from gene therapy. Cutshall’s blood has an even smaller proportion of T cells coming from the therapy, though her immune system is also working well. However, it is difficult to say exactly how much of this improvement is due to gene therapy and how much is a result of continuous enzyme treatment. The result, therefore, is too ambiguous to be interpreted as an unequivocal success in gene therapy (
Some problems can be pointed out in this type of therapy, as the case of DeSilva and Cutshall shows. The cells undergoing treatment have a short life span, which means that often the healthy genetic material cannot reach the whole of the diseased cells. The difficulty in reaching only those cells needing the surrogate gene is also clear. In the case of DeSilva and Cutshall, the cells to be treated could be obtained easily because they were cells of the immune system.
Finally, somatic gene therapy has incalculable oncogenic potential. This risk can be inferred from a case that occurred in France in 2000.At Necker Hospital in Paris, under the leadership of Alain Fischer, two babies with ADA underwent therapy. The innovation was due to the use of stem cells from the bone marrow of the babies. Thus, when stem cells reproduced, they would automatically generate cells with healthy genes in a “self-regenerating genetic correction.” (
The results of the therapy were incredible in the early years, but in 2002, it was discovered that one of the babies had leukemia. Although the oncogenic risk is real, in the case of ADA the result obtained can still be considered advantageous, due to its characteristics and difficulties with treatments.
These risks presented by virus gene therapy, such as shorter cell lifetime and increased oncogenic potential, may also manifest in the CRISPR-Cas9 technique, as reported above.

Moreover, there is a great concern of the German philosopher with the self-understanding of the genetically edited person: “We cannot rule out the fact that knowledge of a eugenic programming of hereditary inheritance limits the autonomous configuration of the individual’s life and undermines relations fundamentally symmetric between free and equal persons.” (
Permission to interfere with the genome in search of contribution to the health of the person can be seen as beneficial, but the limit that guides what is good, preferable or bad is very tenuous. What is really therapeutic and what is just desirable?
Genetic intervention does not open the communication space to address the planned child as a second person and to include it in a process of understanding. [...] The eugenic interventions of improvement undermine the ethical freedom as it subjects the person in question to intentions set by third parties, which the person rejects and are irreversible, preventing them from freely understanding themselves as the sole author of their own life. It may be that it is easier to identify with abilities and aptitudes than with dispositions or even qualities; but for the psychic resonance of the person in question, it only matters the intention that was linked to the purpose of the programming. Only if extreme and highly generalized evils are avoided, good reasons emerge to accept the fact that the affected individual would agree with the eugenic goal (

What can tame men, when after all previous experiments to grow the species up, it remains unclear what it is to be a grown-up? Or is it simply no longer possible to pose the question of the constraint and formation of mankind by theories of civilizing and upbringing? (

But the discourse about difference and the control of taming and breeding indeed, just the suggestion about the decline of awareness of how human beings are produced, and indeed of anthropotechnology these are prospects from which we may not, in the present day, avert our eyes, lest they once again be presented as harmless (
Sloterdijk, walking on dangerous terrain, which prompts a quarrel initiated perhaps by a hasty reading of Habermas, states that the history of culture is a history of selection, from literate and illiterate, and that there are two types of humans, those who created and those who are created, being that the era of the technique perpetuates such division, going towards a problematization on the biological level. Humanity will have to discuss, as the CRISPR-Cas9 technique demonstrated, the technical advances and its capacity to manipulate nature in general and human nature. Where humanism has failed to contain destructive impulses, there will be technique. And as Sloterdijk says, humanity cannot escape the questions about its own self-determination:
But whether this process will also eventuate in a genetic reform of the characteristics of the species; whether the present anthropotechnology portends an explicit future determination of traits; whether human beings as a species can transform birthfatalities into optimal births and prenatal selection these are questions with which, however vague and creepy they may be, the evoluntionary horizon begins to glimmer (

Thus, the Bioethics space in this discussion should be expanded to allow us to understand that any decision regarding the CRISPR-Cas9 technique will imply a series of responsibilities with present and future generations, and it must not escape its interference in nature and it’s consequences.
Global Bioethics is invoked as an important agent of reflection in such a thorny subject, since Genetics demands a Bioethics that projects itself “into the future leads even to a ‘subject’ who does not exist, does not claim and does not have his rights harmed: future generations. Moreover, it also addresses other forms of life, since ethics becomes a part of the philosophy of nature.” (
It cannot be said with absolute certainty that the CRISPR-Cas9 technique will consolidate itself in the scientific circle. Serious science is made gradually by means of tests, counter-tests, experiments and discussions. There is, therefore, a long way to go. However, there is no denying the potential of the technique.
CRISPR-Cas9 has the capacity to enter many practical areas ranging from food production, animal manipulation, pharmacological drugs and finally biotechnology, with emphasis on manipulation in germ cells and embryos. Economic, social, political and scientific interests often cause the subject to be approached in an exalted manner.
After presenting the CRISPR-Cas9 technique, from its origin until its use in implanted embryos, the article presented elements of the Brazilian Biosafety Law. Still, using the debate between the German thinkers Habermas and Sloterdijk, the text exposed concerns about the use of CRISPR-Cas9 in eugenic practice, but also raised the hypothesis of an unavoidable use of the technique in humans.
As the technique is usually always at the forefront of ethicalphilosophical reflection and legal positioning, it is extremely necessary that both areas (Philosophy and Law) carefully reflect on the explosive potential of the CRISPR-Cas9 technique. The virtual change in all aspects of reality makes the CRISPR-Cas9 technique clear object of study for Philosophy (Environmental), Law (Environmental) and Bioethics (Environmental).
On a technical explanation regarding the types of CRISPR/Cas systems: “There are three types of CRISPR/Cas systems (21-23)The type I and III systems share some overarching features: specialized Cas endonucleases process the pre-crRNAs, and once mature, each crRNA assembles into a large multi-Cas protein complex capable of recognizing and cleaving nucleic acids complementary to the crRNA. La nueva técnica de ingeniería genética CRISPR-Cas9 proyecta beneficios y riesgos de manejar y alterar genéticamente organismos vivos, para traer características favorables a ellos mismos y a los seres humanos. Con el enfoque interdisciplinario, involucrando a la Filosofía, el Derecho, la Bioseguridad y la Bioética, el artículo tiene como objetivo verificar cuáles son las consecuencias que el uso de dicha técnica puede traer a la naturaleza genética de los organismos, sobre todo desde los puntos de vista ético y jurídico. Como referencia jurídica y de Bioseguridad, se optó por la Ley brasileña n. 11.105/2005 y, como referencia filosófica y bioética, se abordó la controversia entre los pensadores alemanes Jürgen Habermas y Peter Sloterdijk, que analizaron el tema de la ingeniería genética y del riesgo de la eugenesia. Se trata de una investigación teórico-bibliográfica, que emplea el razonamiento deductivo sobre los impactos jurídicos y filosóficos del uso de la técnica del CRISPR-Cas9. La práctica de la ingeniería genética, a pesar de los riesgos, puede ser un procedimiento inevitable ante la actual etapa de desarrollo humano y enfrentarla con la comprensión de las responsabilidades jurídicas y bioéticas se vuelve esencial.
La manipulación genética siempre estuvo envuelta en polémicas bioéticas y jurídicas. Sin embargo, en los últimos años una nueva técnica de ingeniería genética ha prometido revolucionar los costosos procesos de alteración genética.
La técnica del CRISPR-Cas9 permite sustituir fragmentos de la cadena de ADN por otros, corrigiendo “fallas” genéticas o insertando caracteres benéficos en un determinado organismo.
La posibilidad de tener el control sobre el genoma y las características genéticas de los organismos suscita la reflexión sobre los riesgos de una naturaleza proyectada para los intereses humanos y aún los riesgos de prácticas eugenésicas cuando esas alteraciones se vuelven hacia el genoma humano.
La presente investigación presenta un estudio interdisciplinario, involucrando a la Filosofía, el Derecho, la Bioseguridad y la Bioética con el fin de verificar cómo la técnica del CRISPR-Cas9 puede repercutir en lo que conocemos como naturaleza genética de los organismos vivos, enfrentando los problemas éticos y jurídicos traídos. La referencia jurídica y de Bioseguridad será la Ley brasileña n. 11.105/2005, que aborda las cuestiones de la manipulación e ingeniería genéticas, tanto en células humanas como en otros organismos vivos.
Para reflexionar desde la perspectiva filosófica y bioética, el artículo utiliza la controversia entre los pensadores alemanes Jürgen Habermas y Peter Sloterdijk, que analizaron el tema de la ingeniería genética y del riesgo de la eugenesia.
Se trata, pues, de investigación teórico-bibliográfica, que emplea el razonamiento deductivo de los impactos jurídicos-filosóficos del uso de la técnica del CRISPR-Cas9.
Para ello, se inicia por una exposición de lo que consiste en la técnica del CRISPR-Cas9, en sus aspectos biológicos y biotecnológicos.
Enseguida, se aborda el tratamiento legal de la Bioseguridad en Brasil. Después de contextualizar la Bioseguridad y su desarrollo, se analizan algunos dispositivos de la Ley n. 11.105/2005, pretendiendo dar un panorama de su tratamiento jurídico, dando énfasis a las normas referentes a la manipulación e ingeniería genéticas.
Por último, se confronta la técnica del CRISPR-Cas9 con la terapia génica por medio de adenovirus o retrovirus y se hace una exposición de los riesgos de las técnicas frente a la Bioética.

El 28 de octubre de 2016 la técnica CRISPR-Cas9 fue probada por primera vez en un ser humano. Un equipo chino, liderado por el oncólogo Lu You, de la Universidad de Sichuan, en Chengdu, modificó células con la técnica CRISPR para combatir un cáncer de pulmón en un paciente. El proceso consistió en la retirada de células inmunes de la sangre del paciente, que fueron manipuladas con el CRISPR-Cas9. De esta forma, fue desactivado (cortado) un determinado gen, que tiene como función codificar la proteína PD-1. Tal proteína, eventualmente, perjudica la respuesta inmune de las células, provocando la proliferación de cánceres. Las células editadas fueron cultivadas y su número aumentó. Respeto por las personas ( Equidad: se deben tratar los casos similares de la misma manera y practicar la justicia distributiva en relación a los riesgos y beneficios. Las responsabilidades procedidas son: a) hacer la distribución de tareas y beneficios de las investigaciones; b) permitir el acceso universal y equitativo de los beneficios obtenidos por las investigaciones. Cooperación transnacional: debe haber una colaboración internacional de investigación, teniendo en cuenta los diferentes contextos culturales. Las responsabilidades procedidas son: a) tener respeto por las diferentes políticas nacionales; b) buscar normas comunes; c) compartir datos obtenidos.

El supuesto experimento generó una reacción en cadena. Varios científicos han criticado el hecho de que se haya hecho sin todavía haber consenso en el medio científico sobre la edición genética en seres humanos y su implantación. En la propia China, país de origen del autor de la investigación, donde hay autorización para la edición genética, un grupo de 122 científicos escribió una carta abierta en la que llaman He Jiankui de loco y afirman que tal actividad fue un duro golpe en la reputación y el desarrollo científico de China (
Los incipientes experimentos involucrando la técnica CRISPRCas9 plantean problemas de seguridad y ética en los procedimientos de manipulación genética.
Cierto es que hay riesgos aún desconocidos y la Bioseguridad debe actuar en la prevención de esos riesgos internos (de laboratorio) y externos (en la liberación de los organismos modificados).
La Bioseguridad es el conjunto de técnicas y procedimientos que actúa junto a las investigaciones con material biológico, buscando la prevención, la eliminación o la disminución de los riesgos a la salud humana y al medio ambiente, así como el mantenimiento del equilibrio de los ecosistemas.
En la actuación junto a la biotecnología, se puede afirmar que la Bioseguridad es más pragmática que la Bioética, porque objetiva implementar procedimientos de seguridad, que deben abarcar actividades de investigación, enseñanza, producción y distribución de inventos y de productos biotecnológicos, así como el desarrollo y la prestación de servicios relacionados con la biotecnología.
El marco inicial de la bioseguridad contemporánea está en las reuniones de Asilomar, en California, donde en 1975 ocurrió una serie de reuniones, involucrando a importantes científicos que discutían sobre la ética en la investigación. El tema más relevante, en aquel momento, fue la sugerencia de moratoria de investigaciones genéticas, ocurrida el año anterior por una parcela de científicos.
Por medio de esta reunión se establecieron directrices para la seguridad de los experimentos con ADN recombinante. Aunque la expresión “bioseguridad” no fue utilizada en la época, fue el documento de Asilomar que lanzó las bases de la bioseguridad.
Hoy, los procedimientos de bioseguridad se ocupan principalmente de:
Identificar los riesgos de actividades que involucran el manejo de material biológico; Caracterizar los riesgos según la probabilidad de sus efectos y el alcance de sus posibles consecuencias; Analizar niveles de exposición aceptables a materiales peligrosos o con riesgos aún desconocidos; Evaluar la probabilidad de los efectos negativos de la actividad; Y, en caso de daños, evaluarlos y proponer medidas de contención y reparación.
En Brasil, el principal instrumento regulador de la Bioseguridad es la Ley n. 11.105 Ley de Bioseguridad sancionada por el Presidente de la República el 24 de marzo de 2005.
En cuanto a aspectos generales, la Ley de Bioseguridad establece normas de seguridad y mecanismos de fiscalización sobre construcción, cultivo, producción, manipulación, transporte, transferencia, importación, exportación, almacenamiento, investigación, comercialización, consumo, liberación en el medio ambiente y descarte de organismos genéticamente modificado, teniendo como directrices el estímulo al avance científico en el área de bioseguridad y biotecnología, la protección a la vida y la salud humana, animal y vegetal, y la observancia del principio de precaución para la protección del medio ambiente (
La Ley de Bioseguridad trata, como temas centrales, de la investigación con células madre embrionarias y de la investigación y liberación de organismos genéticamente modificados. Sin embargo, también crea restricciones a las manipulaciones genéticas.
La tramitación de la Ley fue tumultuosa, con presión de grupos económicos interesados en la modificación genética de la soja, hasta entonces desreglamentada. Fue durante la tramitación que el Presidente de la República firmó la Medida Provisional n. 223, de 14 de octubre de 2004 más tarde convertida en la Ley n. 11.092, de 12 de enero de 2005 -, liberando la plantación de la soja transgénica de la cosecha 2004-2005 y la comercialización del producto hasta el 31 de enero de 2006.
Después de la promulgación de la Ley, otra celebración se instauró con relación a la investigación con células madre embrionarias. El 30 de mayo de 2005, el entonces Procurador General de la República, Cláudio Fonteles, protocolizó una petición cuestionando la constitucionalidad del artículo 5 de la Ley de Bioseguridad, que permite la utilización de embriones humanos excedentes de las técnicas de fertilización
El Fiscal General de la República se mostró indignado con el tratamiento normativo dado a la crioconservación de embriones humanos, excedente de fertilización
En el argumento de que
El juicio de la ADI n. 3.510-0 se inició en marzo de 2008, ocasión en que se manifestaron por la constitucionalidad del artículo 5 el Ministro Relator Dr. Carlos Ayres de Britto y la entonces Presidenta del Supremo Tribunal Federal, Ministra Ellen Gracie. La sección fue suspendida en razón de solicitud de vista del Ministro Carlos Alberto Menezes Direito. Retomado el juicio el 28 de mayo de 2008, los Ministros Menezes Dereito y Ricardo Lewandowski votaron por la parcial procedencia del pedido de inconstitucionalidad del artículo 5 de la Ley de Bioseguridad. La Ministra Carmen Lúcia Rocha y el Ministro Joaquim Barbosa lo juzgaban improcedente. Por la improcedencia manifestaron, también, los Ministros Eros Grado y Cezar Peluso, pero con ciertas salvedades, en los términos de sus votos. El juicio fue suspendido y reanudado al día siguiente, el 29 de mayo de 2008. Cogidos los votos de los demás ministros (Min. Celso Mello, Min. Marco Aurélio y Min. Gilmar Mendes) (
Al fin y al cabo, el Supremo Tribunal Federal, por mayoría y en los términos del voto del Relator, juzgó improcedente el pedido constante en la Acción Directa de Inconstitucionalidad n. 3.510-0, vencidos parcialmente, en diferentes extensiones, los Ministros Menezes Direito, Ricardo Lewandowski, Eros Grau, Cezar Peluso y Gilmar Mendes, siendo entonces permitida la investigación con células madre embrionarias, especialmente a partir de la diferenciación del tratamiento jurídico dado al nacer de aquel que se dedica al embrión no gestado y congelado como excedentario de técnicas de reproducción humana asistida (
Las investigaciones y terapias con embriones humanos son permitidas por la Ley de Bioseguridad sólo en cuanto a las células madre, siendo prohibida cualquier técnica de ingeniería genética, de donde se puede inferir que también está prohibida la técnica CRISPR-Cas9. El art. 24 tipifica como crimen, y castiga con detención, de 1 a 3 años, y multa, la conducta de utilizar embrión humano en desacuerdo con las disposiciones del art. 5º, es decir, la utilización de los embriones debe cumplir los siguientes requisitos: a) la investigación y la terapia deben tener por objeto células madre; b) los genitores deberán consentir expresamente en la utilización; c) aprobación previa de los comités de ética en investigación de las instituciones de investigación y servicios de salud involucrados; y d) no se destinan a la comercialización de material biológico (
La alteración genética en embrión recibió una tipificación propia, siendo un crimen punible con reclusión, de 1 a 4 años, y multa (
También es vedada la ingeniería genética en célula germinal humana, lo que fue incluido en el tipo del art. 25, con las mismas sanciones relativas al embrión.
La prohibición de ingeniería genética en embriones y células germinativas humanas fue insertada con el objetivo de evitar una posible eugenesia, o incluso prácticas abusivas e invasivas.
Por último, la Ley de Bioseguridad prohíbe la clonación humana, en cualquiera de sus formas, sea reproductiva o terapéutica (
La clonación es el proceso de reproducción asexual, producido artificialmente, basado en un único patrimonio genético, con o sin utilización de técnicas de ingeniería genética. Si es clonación reproductiva, el objetivo final será la obtención de un nuevo individuo, genéticamente igual al anterior. Si la clonación es terapéutica, su objetivo será la producción de células genéticamente idénticas que puedan ser utilizadas en tratamiento médico.
La clonación está prohibida por medio del artículo 26, que prevé el castigo de 2 a 5 años de reclusión y multa para aquel que la realiza (
En cuanto a la salud humana, la técnica CRISPR-Cas9 abre margen para el perfeccionamiento y la ampliación de la terapia génica, que consiste en el tratamiento de enfermedades, heredadas o adquiridas, en que se manipulan los genes defectuosos a fin de alcanzar la curación o estancamiento de la anomalía.
En teoría, la terapia génica puede realizarse en células somáticas y células germinativas, aunque en estas últimas el riesgo es mucho mayor, pues la alteración de los gametos puede resultar alteraciones inesperadas, como malformaciones y enfermedades hasta entonces desconocidas. Hay, incluso, el riesgo de generar problemas recesivos que podrán manifestarse sólo en generaciones futuras.
Antes de la técnica CRISPR-Cas9, la terapia somática era realizada por un vector, retrovirus o adenovirus, que inserta el nuevo material genético en las células enfermas. Los virus actúan como vectores eficientes por poseer una programación genética que los lleva a transferir su material genético al organismo infectado.
Algunos retrovirus y adenovirus poseen amplia capacidad de propagación de su material genético sin destrucción de las células del organismo invadido. En la terapia somática, se retira parte del genoma del virus, manteniendo su capacidad de reproducción y transferencia, y se inserta el material genético sano a ser transportado. Al infectar las células del paciente, el virus transfiere el material genético que está portando a las células enfermas del organismo, modificando su estructura (
La técnica del CRISPR-Cas9 no se utiliza de otro organismo, como el retrovirus o el adenenovirus. El CRISPR es una secuencia de ADN que se puede repetir varias veces, con secuencias únicas entre las repeticiones, y que permite cortar el ADN en lugares específicos. El Cas9 es la enzima responsable de este corte. Entonces, por medio de una cadena guía de ARN, se retira un pedazo del ADN cortado y lo sustituye por otro.
Aparentemente más eficaz, la técnica de CRISPR-Cas9 sería más precisa que la terapia por intermedio del virus.
La ADA, que ocurre por la ausencia de una enzima, “desactiva” el sistema inmunológico, dejando al paciente vulnerable a cualquier enfermedad.
Células del sistema inmunológico de las dos niñas fueron recogidas y cultivadas en laboratorio, y luego infectadas por retrovirus conteniendo el material genético deseado. El ADN del retrovirus fue transferido a las células, que fueron reinsertadas en las pacientes. Varias infusiones se realizaron durante algunos meses. Paralelamente a la terapia génica, las niñas fueron sometidas a la sustitución enzimática, por exigencia del
Watson y Berry reportan los resultados:
Puedo atestar personalmente que Cutshall parecía una niña muy sana de once años cuando ella y su familia visitaron Cold Spring Harbor en 1992. Once años después, sin embargo, los resultados no se mostraron tan concluyentes. El funcionamiento del sistema inmunológico de DeSilva está cerca de lo normal, pero sólo cerca de un cuarto de sus células T provino de la terapia génica. La sangre de Cutshall tiene una proporción aún menor de células T provenientes de la terapia, aunque su sistema inmunológico también está funcionando bien. Sin embargo, es difícil decir exactamente cuánto de esta mejora se debe a la terapia génica y cuanto es una consecuencia del tratamiento enzimático continuo. El resultado, pues, es demasiado ambiguo para ser interpretado como un éxito inequívoco de la terapia génica (
Algunos problemas pueden ser señalados en este tipo de terapia, como demuestra el propio caso de DeSilva y Cutshall. Las células sometidas al tratamiento tienen un pequeño tiempo de vida, lo que significa que el material genético sano generalmente no puede alcanzar la totalidad de las células enfermas. También es clara la dificultad en alcanzar solamente aquellas que necesitan al gen sustituto. En el caso de DeSilva y Cutshall, las células a ser tratadas podían ser obtenidas fácilmente, por tratarse de células del sistema inmunológico.
Por último, la terapia génica somática presenta incalculable potencial oncogénico. Se puede notar este riesgo a partir de un caso ocurrido en Francia, en 2000. En el Hospital Necker, de París, bajo la jefatura de Alain Fischer, dos bebés con ADA fueron sometidos a terapia. La innovación se debió a la utilización de células madre de la médula ósea de los bebés. Así, cuando las células madre se reprodujeran, generaría automáticamente células con genes sanos, en una “corrección genética autorregenerante.” (
Los resultados de la terapia fueron increíbles en los primeros años, pero en 2002, se descubrió que uno de los bebés presentaba cuadro de leucemia. Aunque el riesgo oncogénico es real, en el caso de la ADA el resultado obtenido todavía puede ser considerado ventajoso, debido a sus características y dificultades con tratamientos.
Estos riesgos presentados por la terapia génica a través de virus, como el menor tiempo de vida celular y el aumento del potencial oncogénico, también pueden manifestarse en la técnica CRISPR-Cas9, como se ha señalado anteriormente.

[...] Las intervenciones eugenésicas de perfeccionamiento perjudican la libertad ética en la medida en que someten a la persona en cuestión a intenciones fijadas por terceros, que ella rechaza, pero que son irreversibles, impidiéndole comprender libremente como el autor único de su propia vida. Puede ser más fácil identificarse con capacidades y aptitudes que con disposiciones o hasta calidades; sin embargo, para la resonancia psíquica de la persona en cuestión, importa sólo la intención que estaba ligada al propósito de la programación. Sólo en el caso de evitar males extremos y altamente generalizados, es que surgen buenos motivos para aceptar el hecho de que el individuo afectado concordaría con el objetivo eugenésico (

Así, el espacio de la Bioética en esa discusión debe ser ampliado para que permita entender que cualquier decisión al respecto a la técnica CRISPR-Cas9 implicará en una serie de responsabilidades con las generaciones presentes y futuras, siendo forzoso no escapar de sus interferencias en la naturaleza y consecuencias.
Se invoca la Bioética Global como importante agente de reflexión en un tema tan espinoso, puesto que Genética exige una Bioética que se proyecta “en el futuro de los candidatos a un sujeto que no existe, no importa y no tiene sus derechos harmed: futuro generaciones. “Además, también hay otras formas de vida, desde los éxitos se convierte en parte de la filosofía de la naturaleza.” (
No se puede afirmar con absoluta certeza que la técnica CRISPRCAS9 se consolidará en el medio científico. La ciencia seria es hecha paulatinamente por medio de pruebas, contrapruebas, experimentos y discusiones. Por lo tanto, hay un largo camino por recorrer. Sin embargo, no se puede negar que el potencial de la técnica es innegable.
El CRISPR-Cas9 tiene la capacidad de adentrar innumerables áreas prácticas que van desde la producción de alimentos, pasando por la manipulación de poblaciones animales, por el área de fármacos y, finalmente, por la biotecnología, con destaque para la manipulación en células germinativas y embriones. Los intereses económicos, sociales, políticos y científicos hacen que el tema a menudo sea abordado de manera exaltada.
Después de presentar la técnica CRISPR-Cas9, de su surgimiento hasta el uso en embriones implantados, el artículo presentó elementos de la Ley de Bioseguridad en Brasil. El texto expuso las preocupaciones con el uso del CRISPR-Cas9 en la práctica eugenésica, pero también plantea la hipótesis de un inevitable uso de la técnica en los seres humanos, habiéndose de los debates entre los pensadores alemanes Habermas y Sloterdijk.
Como la técnica, normalmente, está siempre al frente de una reflexión ética-filosófica y de un posicionamiento jurídico, es extremadamente necesario que ambas áreas (Filosofía y Derecho) reflejen con cuidado los potenciales explosivos de la técnica CRISPR-Cas9. El virtual cambio en todos los aspectos de la realidad hace que la técnica CRISPR-Cas9 objeto claro de estudio para la Filosofía (Ambiental), el Derecho (Ambiental) y la Bioética (Ambiental).
Sobre una explicación técnica sobre los tipos de sistemas CRISPR/Cas: “There are three types of CRISPR/Cas systems (21-23). The type I and III systems share some overarching features: specialized Cas endonucleases process the pre-crRNAs, and oncemature, each crRNA assembles into a large multi- Cas protein complex capable of recognizing and cleaving nucleic acids complementary to the crRNA. El debate Habermas-Sloterdijk tuvo origen cuando algunos periodistas publicaron fragmentos des- contextualizados de una conferencia de Sloterdijk (originalmente presentada el 15 de junio de 1997 en la ciudad de Basilea, en un evento sobre el humanismo y luego reanudada en junio de 1999 en un colo- quio sobre Heidegger y Levinas en Elmau y que dará origen al texto Reglas para el parque humano), dando a entender que el autor estaba a favor de prácticas eugenésicas. La reacción de Habermas, que ocurrirá, inicialmente, en la prensa de manera violenta, resultará en la obra El futuro de la naturaleza humana. En nuestra visión, Habermas jamás comprendió efectivamente el texto de Sloterdijk.
